The office of the Examiner of Surveys has prepared the attached guidelines for acceptable descriptions for utility caveats and subdivisions registered under the Real Property Act.
This document is intended to be used by parties who have a working knowledge of the laws and policies that govern the Manitoba Land Titles System (such as lawyers, legal assistants and surveyors) as a supplement to their existing body of knowledge.
Parties who do not have this essential knowledge are advised that this document does not constitute legal advice and cannot take the place of proper professional advice, either from a lawyer or a surveyor.
The guidelines have been broken into two parts:
Part 1 – Guidelines for Acceptable Legal Descriptions for Easements (Statutory and Otherwise)
Part 2 – Guidelines for Acceptable Legal Descriptions for Subdivisions
Please Note: The guidelines for descriptions will also apply to agreements filed under the old system.
