In addition to the rules for the creation of building/development schemes that arise from the common law (see Caveats, Restrictive covenant caveats), subsection 76.2 of The Real Property Act allows for the creation of development scheme by, either an agreement or a declaration. An agreement is to be used where the affected lands do not have common ownership, while a declaration is to be filed if all of the affected lands have common ownership.
